What are Personal Assistance Services (PAS)?

Personal Assistance Services (PAS) refer to support services that assist individuals with disabilities in performing activities of daily living they would typically handle independently if not for their disability. These services are comparable to those provided by home caregivers or paraprofessionals, focusing on empowering individuals to maintain their independence and quality of life.

PAS aligns with the mission of the U.S. Department of Labor’s Office of Disability Employment Policy (ODEP) to “Drive Change and Create Opportunity,” ensuring equitable access to essential resources and promoting inclusive practices for individuals with disabilities.

Personal Assistance Services (PAS) for Federal Employees

For federal employees, PAS is available exclusively to individuals with a “targeted disability,” as defined by the Federal Office of Personnel Management (OPM). These disabilities include:

  • Deafness
  • Blindness
  • Missing extremities
  • Partial paralysis
  • Complete paralysis
  • Convulsive disorders
  • Intellectual disabilities
  • Mental illness
  • Distortion of limb and/or spine

PAS is provided to current employees, job applicants, and visitors who require assistance with activities of daily living, ensuring equal employment opportunities and access to relevant facilities. These services empower individuals to participate fully in the workplace and enjoy equal access to employer-sponsored events.

With the rise in unemployment, what are we doing to help our most vulnerable, those that are disabled? On January 3, 2018, the Equal Employment Opportunity Commission amended Section 501 of the Rehabilitation Act of 1973 and now requires all federal agencies to provide personal assistance services to help people with targeted disabilities with daily living activities.

There are 33,153,211 disabled individuals aged 16 to 64 in the United States but only more than 18 million have been able to find employment. The regulation applies to all federal agencies. There are no waivers. Since 2018, Precision Healthcare was the first and only vendor awarded the sole IDIQ contract to provide these needed services for all operating divisions of the United States Health and Human Services, which includes EEO, ACF, CDC, CMS, FDA, NIH, and IHS. Although these regulations are not mandated to our private businesses, many have begun to put these reasonable accommodations in place to assist employees with disabilities.

PAS Procedures and Requirements

On January 3, 2017, the U.S. Equal Employment Opportunity Commission (EEOC) issued a Final Rule amending the regulations implementing Section 501 of the Rehabilitation Act of 1973 (29 C.F.R. §§ 1614.203, 601(f)). The regulations require:

  • PAS in the Workplace: Assistance for activities of daily living not covered as a reasonable accommodation.

  • Affirmative Action: All federal agencies must provide PAS beyond nondiscrimination obligations.

  • Telework Inclusion: PAS must be available during remote work arrangements.

  • Employer-Sponsored Events: PAS must be provided at events like holiday parties and training sessions.
